TERMS OF SERVICE

By enrolling in the PROJECT PATCH Program ("the Program"), you acknowledge and agree to abide by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("the Student") and PROJECT PATCH, operated in the state of Massachusetts.
1. ACCEPTANCE OF TERMS
1.1 Implied Consent After Payment
By scheduling your appointments and making a payment for patch coaching, you confirm that you have read, understood, and agreed to these Terms of Service. These terms constitute a legally binding agreement between you ("the Student”) and PROJECT PATCH ("Company," "we," "our," "us"). A ‘Patch’ refers to the time between when Riot Games implements a numerical patch and the next numerical patch release. Minor or interim updates (‘B-patches,’ ‘C-patches,’ etc.) and patch extensions due to Riot Games’ scheduling do not reset the number of coaching sessions.
2. PROGRAM OVERVIEW
2.1 Program Structure
PROJECT PATCH provides a structured coaching program for Teamfight Tactics players. The Program provides mentorship and coaching services in Teamfight Tactics (TFT), including:
Four separate, 90-minute sessions with a dedicated coach all within a specific patch
Direct access to DM’s with your coach to discuss your personal improvement
PROJECT PATCH reserves the right to modify coaching content, structure, or assigned coaches as necessary to maintain program quality.
3. Eligibility
3.1 Applicant Requirements
Applicants can be of any rank to sign up, but some coaches may have a ranked requirement. Make sure to double check if a coach has a rank requirement before signing up.
Participants under 18 require parental consent.
4. PAYMENT AND NO REFUND POLICY
4.1 Payment Terms
The full cost depends on each coach and their specific rate, which can be scheduled via Tidycal. The cost is payable upfront through the coach’s specific Tidycal booking link, available via projectsbykai.com/patch-coaching.
4.2 Refund Policy
No refunds will be issued under normal circumstances, including but not limited to:
Student dissatisfaction with the mentorship or coaching
Student’s inability to participate due to personal reasons
Lack of improvement or success in TFT
Changes in personal schedule, game balance, or competitive format
Refunds may be granted under extreme circumstances, such as medical leave or forced military enlistment that was unknown to the player before enrolling. This is handled on a case-by-case basis and must be discussed directly with Kai via Discord DMs.
If a Student must reschedule their sessions, please refer to Section 5.2 (Rescheduling Policy).
In all cases, the maximum refund or compensation a Student may receive shall not exceed the total amount paid for the Program.
5. PROGRAM PARTICIPATION
5.1 Expected Participation
The following lists the program participation expectations of all Students in the program:
Students can book with their Coach to schedule their coaching sessions based on the Coach’s availability, which can all be found on their Tidycal booking site.
Each Student is entitled to two coaching sessions per week, each lasting 90 minutes.
Each Student is entitled to four coaching sessions in total for the duration of a patch.
If a Coach becomes unavailable, PROJECT PATCH does not guarantee a replacement.
If the designated Coach becomes unavailable for an extended period (e.g., due to illness or personal emergency), PROJECT PATCH will make reasonable efforts to assign a new Coach or reschedule sessions.The final decision on how to proceed will be made by Kai.
Refunds related to coach unavailability will follow the same proportional refund principles described in Section 4.2.
The final decision regarding refunds, including the amount and eligibility, is at Kai’s sole discretion.
Students may not transfer or assign their enrollment in the Program to another person.
PROJECT PATCH reserves the right to modify or cancel sessions due to unforeseen scheduling conflicts, provided reasonable notice is given to the Student.
5.2 Rescheduling Policy
If a Student needs to reschedule a time with their Coach, they can do so informally by directly messaging (DM’ing) their Coach, and to find a time that works for both parties.
In the event that a mutual rescheduling time cannot be reached before the next numerical patch, the student is entitled to a rescheduled session on a different new patch.
6. Intellectual Property & Sharing Policy
6.1 Section Overview
The following lists PROJECT PATCH’s intellectual property and sharing policy in regard to original content, sharing information, and coaching sessions.
PROJECT PATCH retains ownership of all program materials, including coaching methodologies, reports, tournament structures, and proprietary strategies.
Students may share what they have learned.
Students may redistribute program materials but may not claim materials such as VOD review sessions, progress reports, or other structured content as their own work.
By enrolling in the Program, you expressly consent to being recorded during coaching sessions and VOD reviews. These recordings may be used for internal review, analysis, or educational purposes. Additionally, these recordings could potentially be shared publicly, unless you submit a written request to Kai, specifying your desire to be excluded from any such sharing of media.
To be considered an enforceable request, the written request can be informal but must include proof that Kai has acknowledged and responded to your request. Once such a request has been acknowledged by Kai, any relevant media will be removed from public sharing, as per the request, and Kai must ensure compliance.
Failure to submit an acknowledged request may result in media being used or shared publicly as part of the Program's content.
Students may not use PROJECT PATCH materials for commercial purposes without prior written consent.
7. Code of Conduct
7.1 Student Behavior
Students are expected to conduct themselves professionally within the PROJECT PATCH community and any associated platforms (including Discord). Any harassment, inappropriate behavior, hate speech, doxxing, or toxic in-game behavior may result in immediate removal from the Program without a refund. PROJECT PATCH reserves the right to determine what constitutes inappropriate behavior.
Enforcement:
Warnings may be issued at Kai’s sole discretion.
Immediate removal is possible based on the severity of the offense.
Students may appeal their removal by speaking directly with Kai, but the final decision rests solely with Kai.
7.2 Coach Behavior
Coaches are expected to conduct themselves professionally within the PROJECT PATCH community. If a Student believes that their Coach is acting in a manner that is rude, uncooperative, unresponsive, or unprofessional, they should notify Kai immediately.
Evidence will only be considered valid if:
It comes from messages found in DMs between both the Student and Mentor specifically, with no other outside parties.
It consists of video evidence from coaching sessions or VOD reviews.
Coaches are not required to record sessions, so Students are strongly encouraged to record their VOD review sessions in case evidence is needed.
Any reported issues will be reviewed by Kai, and appropriate action will be taken at Kai’s sole discretion.
8. Disclaimers and Limitation of Liability
8.1 Section Overview
PROJECT PATCH does not guarantee specific results, rankings, or earnings as a result of participation in the Program. The Program is designed to provide mentorship and coaching, but individual improvement depends on the Student’s effort, skill, and commitment.
PROJECT PATCH shall not be held liable for any losses, including but not limited to:
Financial losses
Missed competitive opportunities
Emotional distress or dissatisfaction with coaching outcomes
8.2 Force Majeure and Refund Requests Under Extreme Conditions
In the event of a force majeure (e.g., natural disasters, government actions, pandemics), a refund will be calculated based on the number of sessions the Student has completed up until the force majeure, relative to the total number of sessions initially scheduled for the Program. The refund amount will be calculated as a percentage of the Program fee, with the total fee reduced based on the proportion of remaining sessions. The more sessions the Student has participated in, the smaller the refund. To the maximum extent permitted by law, PROJECT PATCH’s total liability under these Terms shall not exceed the amount paid by the Student for participation in the Program.
8.3 Third-Party Services
PROJECT PATCH is not responsible for any issues related to third-party services used in conjunction with the Program, such as Discord, payment processors, or external coaching tools. Any issues with these services should be directed to the relevant third-party provider.
9. Dispute Resolution & Governing Law
9.1 Section Overview
Any disputes arising under these Terms shall be resolved exclusively in the courts of Massachusetts under Massachusetts law, without regard to conflict of law principles.
9.2 Failure or Delay in Performance
PROJECT PATCH shall not be held liable for failure or delay in performance due to causes beyond our reasonable control, including but not limited to:
Natural disasters.
Government actions.
Internet or technical failures.
Pandemics or health-related restrictions.
Any other unforeseeable event that prevents the fulfillment of the Program.
10. Changes to Terms
10.1 Terms of Service Changes
PROJECT PATCH reserves the right to update these Terms at any time. Continued participation in the Program after changes to the Terms constitutes acceptance of the revised terms.
Students will be notified of material changes via email or Discord announcement prior to the changes taking effect.
11. Privacy policy
11.1 Privacy Policy Overview
PROJECT PATCH is committed to protecting the privacy and security of your personal information. By enrolling in the Program, you consent to the collection, use, and sharing of your personal data in accordance with this section and any applicable laws. We collect personal data necessary to provide you with the services included in the Program, such as contact information, payment details, and any information you provide during coaching sessions. This data is stored securely and used solely for the purposes of administering the Program, including communications with you, managing your progress, and providing you with coaching and mentorship. PROJECT PATCH complies with applicable privacy laws, including U.S. federal and Massachusetts state data protection standards.
11.2 Data Sharing
We do not sell or share your personal information with third parties for marketing purposes. However, we may share your data with trusted third-party service providers necessary for the execution of the Program (e.g., payment processors, coaching tools, and email platforms). These third parties are contractually obligated to protect your data in accordance with applicable laws.
11.3 Your Rights
You have the right to request access to, correction of, or deletion of your personal data. To exercise any of these rights, please contact Kai directly via Discord or email at contact@projectsbykai.com.
11.4 Data Retention
We will retain your personal data for as long as necessary to fulfill the purposes outlined in the Program or as required by law.
11.5 Privacy Policy Acknowledgement
By participating in the Program, you acknowledge that you have read, understood, and agree to the collection and processing of your data as described in this section.

13. GENERAL PROVISIONS
13.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13.2 Entire Agreement
These Terms constitute the entire agreement between the Student and PROJECT PATCH regarding the Program and supersede any prior understandings, communications, or agreements.
13.3 Non-Affiliation Disclaimer
PROJECT PATCH and its coaches are independent and not affiliated with or endorsed by Riot Games, Inc. “Teamfight Tactics” and related terms are trademarks of Riot Games, Inc.
